This research report on Opportunities in the ADR Field in Georgia was compiled by Jennifer Matte. Ms. Matte is Vermont Law School graduate. During law school, she completed an externship with the Consortium for Negotiation and Conflict Resolution. Her work with The Center for Legal Solutions, Inc. has primarily focused on the emergence of specializations within the ADR community.

Opportunities with the Department of Labor's Vocational Rehabilitation Program

The GA Department of Labor Vocational Rehabilitation Program GDOL/VR provides services to help people with disabilities prepare for, start, and maintain competitive employment

VR is an eligibility, not an entitlement, program. To qualify for services the individual must have a permanent physical or mental impairment which interferes with the ability to work and Vocational rehabilitation services are necessary for this individual to prepare for, enter, engage in, or keep gainful employment and the individual with a disability can, will, and wants to go to work

The VR program is backed by the Client Assistance Program which provides assistance in informing and advising clients of their available benefits under the Rehabilitation Act of 1973

ADR and mediation is available for those wishing to pursue legal, administrative, or other remedies to ensure that the individualē—“ rights under the Rehabilitation Act are protected


Who performs the mediation? How is this determined?

A client or applicant who does not agree with a decision by the VR Program regarding the provision or denial of services may request a review and re-determination of the decision

Negotiation may be facilitated by the policy consultant or Employment Manager or Regional Director

Mediation is facilitated by an impartial qualified mediator


What are the requirements for training in order to mediate these disputes? How much experience is suggested or required?

Members of the GA Department of Labor have received mediation training in order to further the adoption of alternative dispute resolution for due process claims

For due process claims, impartial hearings are conducted by Administrative Law Judges within the Office of State Administrative Hearings (OSAH)


What is the pay rate for a mediator of this type? How is payment structured?

OSAH also provides mediation through certified mediators at no cost to the GDOL/VR Program
