This research report on Opportunities in the ADR Field in Georgia was compiled by Jennifer Matte. Ms. Matte is Vermont Law School graduate. During law school, she completed an externship with the Consortium for Negotiation and Conflict Resolution. Opportunities with the Department of Transportation

Any utility using or occupying a road that the department selects for improvement shall relocate or make adjustments when their facility constitutes an obstruction or interference with the use or safe operation of the road or when it will interfere with maintenance

The owner of the utility may be responsible for a liable to the department for damages resulting from a failure of the utility to comply with requirements of a submitted work plan. The utility may be liable for delay costs as well.

The utility company is given 45 days after notification to wither pay the amount of the damages or request mediation

The Department “Utility Relocation Procedures” include provisions for the establishment of mediation boards to hear and decide disputes that may arise between the department and the utility


Who administers the program?

The program falls under The Department of Transportation Utility Relocation Procedures and is administered by the Department


Who performs the mediation?

Mediation is performed by a mediation board

The mediation board consists of: One mediator designated by the department One mediator designated by the utility One independent mediator mutually selected by both the utility and department (The independent mediator will serve as the presiding officer of the board)

The mediators will issue a final decision in writing with regard to each dispute submitted for resolution

All final decisions of the board are subject to de novo review by the Superior Ct of Fulton County
