Who Should I Select as Arbitrator?
The arbitrator is typically selected by mutual agreement of the parties. It is suggested that parties consider candidates that are likely to be agreeable to all parties.
We would also suggest that the parties select an arbitrator who has substantial practical experience in the subject area that is in dispute. The arbitrator should be able to apply the relevant laws to the case to fairly resolve all the issues.
The parties may also wish to consider the hourly rates charged by prospective arbitrators and whether it is necessary to have an arbitrator available to suit a particular time schedule.
A person who has served as a mediator generally may not later serve as an arbitrator in the same case, absent written agreement of the parties, because information regarding settlement shared with a mediator is confidential and should not factor in an arbitration award between the parties.
You may review profiles of individuals who arbitrate domestic relations cases, civil and commercial matters at The Center for Legal Solutions. If the parties cannot agree upon an arbitrator, The Center for Legal Solutions may facilitate a selection process among several qualified candidates.
